These Terms of Use (the Terms) govern the use of www.liquorbarons.com.au (the Website) and all related sites and content including copyright, data, text, software, images, graphics, trademarks, logos, interfaces, photographs and other intellectual property. The Website and all its content is owned and operated by Liquor Barons Co-Operative Limited ABN 15 806 131 743 (Liquor Barons) with the principal place of business at 4/40 Churchill Avenue, Subiaco, Western Australia.

  1. By visiting and using the Website you accept and agree to be bound by all the Terms. Liquor Barons may vary these Terms at any time, and by continuing to use the Website you consent to any variation. Liquor Barons will not notify users of any variations, so please regularly check these Terms for any variations. If you do not accept these Terms, please do not use the Website.
  2. The use of the Website and the content on the Website is for personal, non-commercial purposes only, unless consented to in writing by Liquor Barons. All copyright and other rights (including, without limitation, intellectual property rights) in and to the Website and the material on the Website are owned by Liquor Barons. Users may not use, adapt, modify, sell, license, distribute, transmit, display, publish or create works derived from the Website or the material or any part thereof without prior written consent from Liquor Barons, which may be withheld in the absolute discretion of Liquor Barons (except as otherwise permitted by applicable law).
  3. Certain material provided or available on or through the Website may be stated to be subject to special or additional rules or conditions which will form part of these Terms.
  4. Whilst Liquor Barons derives information from sources which Liquor Barons believe to be accurate and up to date at the time of publication, aside from our obligations under the Australian Consumer Law, Liquor Barons makes no representation or warranty that the content on the Website is accurate, up to date or complete or that any expressions of opinion or statements of intention are reasonable or honest. Liquor Barons do not warrant or guarantee that access to the Website will be uninterrupted or error free, that any defects will be corrected immediately or that the Website will be free from viruses or contamination. Except where prohibited by law, Liquor Barons will not be liable to its users for any loss, damage, claims or expenses that said users may suffer do to the use of the Website and/or any information on it.
  5. Users of the Website may post product reviews. This right is extended on condition that the review is not illegal, obscene, abusive, threatening, defamatory, an invasion of privacy, infringing of intellectual property rights, or otherwise injurious to third parties, or objectionable. Specifically, product reviews should not include software viruses, political campaigning, commercial solicitation, chain letters or mass mailings.
    You may not use a false email address, impersonate any person or entity, or otherwise mislead as to the origin of any content within a review. We reserve the right, but not the obligation, to remove or edit any content. If you post a product review, unless indicated otherwise, you grant Liquor Barons a non-exclusive, royalty-free and fully sub-licensable right to use, reproduce, publish, modify, adapt, translate, distribute the content.
  6. The Websites contains links to other websites which may be controlled by third parties (Third Party Websites). Liquor Barons is not responsible for any content on Third Party Websites nor does it enforce or approve such websites. The user accepts that visiting Third Party Websites is done at the users own risk and enquiries should be made when relying on any content contained in Third Party Websites. Liquor Barons makes no representations or warranty on the quality or accuracy of material available on Third Party Websites, or that such material does not infringe the intellectual property rights of a third party.
  7. This Website uses “cookie” information collection technology. Cookies may also be used by companies to which we link. It is the users responsibility to use a browser which does not (or is configured not to) accept cookies should the user not wish to receive them. Be advised, however, that doing so may limit the functionality of the Website.

These Terms are governed by the laws of Western Australia, and any dispute in relation to these Terms or your access or use of the Website will be the exclusive jurisdiction of the Courts in Western Australia. If any of these Terms are unenforceable or held to be invalid, the offending provision/s will be removed from these Terms and the amended Terms will remain in force. Any failure by Liquor Barons to act or enforce these Terms immediately will not be considered a waiver of Liquor Barons right to take any such action.

Liquor Barons Locals Club: Terms and Conditions

1. Introduction
1.1 These Terms and Conditions set out the rights and obligations of Membership to the Liquor Barons Locals Club.

1.2 Whilst every effort has been made to ensure the information provided to Members in relation to the Liquor Barons Locals Club is correct, Liquor Barons accepts no responsibility for any inaccuracy.

1.3 The laws of the State of Western Australia and the Commonwealth of Australia govern these Terms and Conditions.

1.4 By completing an application for Membership, the Local agrees to be bound by these Terms and Condition.

2. Definitions
2.1 In these Terms and Conditions unless the context otherwise requires:

“Liquor Barons Locals Club” means the rewards and Benefits program conducted by Liquor Barons for Liquor Barons Store customers who become Locals;

“Benefits” means any of the specials, discounts, competitions or promotions offered or available to the Local from time to time as a result of Membership in Liquor Barons Locals Club;

“Card” means the Barons Locals Club Card issued to the Local, which may be a physical card or virtual card and which has a unique barcode relating to the Membership;

“Content” means all copyright, database rights text, graphics, interfaces, photographs, trademarks, logos, sounds, music, artwork, software and other intellectual property rights;

“Frequent Buyer Scheme” means the program conducted by Liquor Barons means under which a Local earns Points and qualifies for rewards under these Terms and Conditions;

Or “Liquor Barons” means Liquor Barons Co-Operative Limited;

“Liquor Barons Store” means those stores participating in the Frequent Buyer Scheme;

“Local” means the member of the Liquor Barons Locals Club;

“Membership” means the membership by a Local in the Frequent Buyer Scheme;

“Points” means points earned by the Local for purchases made at Liquor Barons Stores in accordance with these Terms and Conditions.

“Terms and Conditions” means these Terms and Conditions, as amended from time to time.

3. Changes to the Terms and Conditions
3.1 Liquor Barons may change these Terms of Use from time to time.  The Local’s continued use of the Card following any changes mean that the Local accepts and agrees to the updated version of these Terms and Conditions.

3.2 Liquor Barons reserves the right to make any changes to the Terms and Conditions in its sole discretion, at any time and without notice to the Local.

3.3 Liquor Barons reserves the right, in its absolute discretion to withdraw, cancel or in any way change any of the Benefits advertised or offered to the Local, at any time.

3.4 Liquor Barons will not be liable for any loss or damage suffered by the Local resulting from such withdrawal, cancellation or change.

4. Membership
4.1 Membership of Liquor Barons Locals Club is open to individuals who are at least eighteen years of age and have a current Australian residential address.

4.2 In order to apply for Membership, a Local must complete an application form online, in-store or in any other form required by Liquor Barons.

4.3 Membership is offered at the discretion of Liquor Barons, and it has the right to accept or reject any application for Membership for any reason.

4.4 The Local is responsible for advising Liquor Barons of any change of contact details (including, but not limited to, address, email address or phone number). If Liquor Barons do not have correct details of a Local, Liquor Barons may not be able to contact the Local and may restrict the Locals Membership, including to redeem Points and Benefits.

4.5 The Local is also responsible for advising Liquor Barons if the Card is lost or stolen or if the Local would like to be removed from the account.

4.6 The Local consents to receive communications from Liquor Barons regarding the Liquor Barons Locals Club and other goods and services offered by Liquor Barons and its related entities. The Local may opt-out of receiving communications directly or by contacting Liquor Barons.

5. Use of the Card
5.1 The Card is and remains the property of Liquor Barons and must be returned on demand.

5.2 The Card is valid for use only by the Local and is not transferrable in any circumstances.

5.3 Liquor Barons may charge the Local to replace a lost or stolen Card.

6. Earning Points
6.1 Liquor Barons will credit Points to the Local’s Card when the Local makes a purchase at any Liquor Barons store and provides their Membership details at the time of purchase, or as soon as reasonably practicable following an eligible transaction. Liquor Barons is not responsible for any delay to credit Points to a Local. The Local should contact Liquor Barons to dispute the Points awarded for a transaction.

6.2 Unless otherwise stated, the Local will receive 1 standard point for every $1 spent at a Liquor Barons Store.  Liquor Barons reserves its right to change the earning rate at any time without notice to the Local, by updating these Terms and Conditions.

6.3 Liquor Barons may also issue bonus points (in addition to any standard points) under special promotions, from time to time.

6.4 Points may only be credited to one Card.

6.5 Unless otherwise provided in these Terms and Conditions, accumulated Points cannot be sold, assigned, transferred, or otherwise redeemed whether for value consideration or otherwise.

6.6 Liquor Barons may correct or amend the Points balance in a Local’s account for any points credited in error and any points relating to a purchase which is cancelled or reversed or where a refund is given.

6.7 Points do not expire unless the Local does not earn or redeem any points on their account for a period of 24 consecutive months, then the Points, will automatically expire and Liquor Barons may terminate Membership and close the account. Liquor Barons will not contact the Local to advise of this.

6.8 A Local may check their points balance at any time by contacting Liquor Barons.

7. Redeeming Points
7.1 When a Local has sufficient Points credited to their account, the Local may use the Points in exchange for rewards at a Liquor Barons store.

7.2  Unless otherwise stated, one point is worth $0.01 and can be redeemed against purchases at a Liquor Barons Store.  The Local may redeem points in no less than $10 amounts.  Liquor Barons reserves its right to change the redemption rate at any time without notice to the Local, by updating these Terms and Conditions.

7.3 The Local must provide sufficient evidence of their Membership to Liquor Barons in order to redeem their Points or receive any Benefits.

7.4 All rewards are subject to availability. Liquor Barons is not responsible to the Local if any reward is not available for any reason.

7.5 The Local must choose the reward carefully. Once the Local has redeemed points for a reward, it cannot be exchanged, canceled, or refunded for any reason except where that reason is covered by a consumer guarantee in the Australian Consumer Law (for instance, where the reward is faulty or not as described).

7.6 Liquor Barons reserves the right to make any changes at any time to the range of available rewards or the number of points required for a reward, irrespective of the effect on Locals’ points without prior notice and at the absolute discretion of Liquor Barons.

7.7 Rewards may be subject to other terms, conditions and restrictions as are communicated or referred to by Liquor Barons from time to time, or in the course of a Local redeeming points for a reward.

7.8 A Local may opt to transfer Points to selected charities or clubs, that have been pre-approved by Liquor Barons and set up with an account to receive points.

8. Benefits
8.1 Liquor Barons may, in its absolute discretion, offer specials, discounts, competitions or promotions to the Local from time to time as a result of Membership in Liquor Barons Locals Club.

8.2 Such Benefits may be subject to further specific terms and conditions that Liquor Barons may communicate to the Local from time to time.

9. Termination
9.1 The Local may terminate the Membership at any time and for any reason by contacting Liquor Barons.

9.2 Liquor Barons reserves the right at any time in its absolute discretion and without notice to terminate the Membership of the Local where the Local:

  • fail to comply with these Terms and Conditions;
  • provides misleading information or make any misrepresentation to Liquor Barons;
  • acts in any way which is likely to be detrimental to the interests of Liquor Barons or the Liquor Barons Local Club.
  • is abusive or offensive to staff of Liquor Barons

9.3 Upon any termination, the Membership, rights and licences granted to the Local will immediately terminate and the local will not be able to earn or redeem Points.  Any Points accrued will be deleted.

9.4 Liquor Barons will not be liable to the Local for the termination of the Frequent Buyer Scheme for any reason whatsoever, including (without limitation) for any Points at the time of termination.

10. Security
10.1 The Liquor Barons Privacy Policy forms part of these Terms and Conditions. By becoming a Local, the Local agrees for Liquor Barons to collect data and related information about the Local and its engagement in the Frequent Buyer Scheme.

10.2 Liquor Barons does supply data to some suppliers for market research. This is done in accordance to the Privacy Policy.

10.3 Liquor Barons may provide personal information of a Local to parties involved in a purchase or potential purchase of any part of our business.

11. Intellectual Property
11.1 All intellectual property rights in relation to the Liquor Barons Locals Club are either owned or controlled by Liquor Barons.

11.2 Except as expressly provided in these Terms and Conditions, no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way, or used for any commercial purpose without the prior written consent of Liquor Barons.

12. Liability
12.1 Any liability Liquor Barons may have to a Local in negligence, breach of contract or otherwise, and all conditions and warranties as to the condition, suitability, quality, fitness or safety of any goods or services supplied by Liquor Barons whether express or implied by statute, are excluded to the extent permitted by law, and, where liability cannot be excluded, liability to a Local will in all cases be limited to:

  • the cost of re-supplying the goods or services or repairing, or paying the costs of repairing, the goods;
  • reinstating number of Points in dispute; or,
  • where the dispute relates to a reward, the number of points required to redeem the reward.

 

Liquor Barons Locals Club “SHOP’N’WIN” Terms and Conditions

Liquor Barons Co-Op Ltd (the “Promoter”) Any and All Local Competitions (the “Promotion”)

  1. Information on how to enter the Promotion and associated prizes form part of these Terms and Conditions.
  2. Entry into the Promotion is deemed acceptance of these Terms and Conditions.
  3. See point of sale for the Promotion start and end date and time.
  4. Subject to these Terms and Conditions, entry to the Promotion is open to WA residents over the age of 18.
  5. Employees of the Promoter, their retail stores and advisers (including any advertiser or advertising agency) and each of their immediate families are ineligible to enter the Promotion.
  6. To be eligible to enter the Promotion, an entrant must be a Liquor Barons Locals Club member (a Local).
  7. Each time an eligible Local purchases any qualifying product from a Promoter store they automatically receive one entry to go into the draw for a chance to win the prize.  The Local must scan their Local club card or barcode at the time of purchase to enter.
  8. Unless otherwise stated, the draw for the Promotion will be conducted at the Liquor Barons administration office located at Suite 4/40 Churchill Ave, Subiaco, WA 6008, following the close of the Promotion.
  9. Unless otherwise stated, the winner(s) will be chosen at random from a database of all entries received. The Promoter’s decision is final and no correspondence will be entered into regarding the Promotion result.
  10. The Promoter will attempt to contact winner(s) using the telephone number and/or email address provided by the Local. If for any reason the details are incorrect, the Promoter will not be held responsible. If for any reason the Promoter is unable to contact a winner within 7 days (which may be extended at the sole discretion of the Promoter) of the prize draw, the winner will forfeit the prize and a re-draw will be conducted.
  11. Incomplete or inaccurate entries will be deemed invalid.
  12. The winner may be required to collect a prize from the Promoter.
  13. All prize winners agree to participate in marketing, publicity or advertising as reasonably requested by the Promoter.
  14. By entering into the Promotion the Local consents to the Promoter using, modifying and disclosing the Local’s name, likeness, image or voice (including photograph, film or recording) in any media (including making them available on the Promoter’s social media pages and all information provided by the Local to the Promoter at any time, for an unlimited time, anywhere in the world, without further reference, payment or any other compensation to the Local for the promotion of any of the Promoter’s products or services.
  15. Locals may only enter in their own name. The Promoter reserves the right to request a winner to produce (within a requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the winners’ identity, age, residential address, eligibility to enter and claim the prize, and any information submitted by the winner(s) in entering the Promotion before issuing a prize. If the documentation required by the Promoter is not received by the Promoter or the winning entry has not been verified or validated to the Promoter’s satisfaction within the time requested, the winner’s entry will become invalid. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered. A prize may only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
  16. The Promoter reserves the right, at any time, to verify the validity of entries and Locals (including a Local’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct.
  17. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this Promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.
  18. The Promoter makes no representations or warranties as to the quality, suitability or merchantability of any goods or services offered as part of the Promotion.  To the extent permitted by law, the Promoter is not liable for any loss (including indirect and consequential loss) suffered to person or property by reason of any act or omission (including deliberate or negligent acts or omissions) by the Promoter or its employees or agents, in connection with the arrangement for the supply, or the supply, of goods or services by any person to the prize winners and, where applicable to any persons accompanying the prize winners.  This clause does not affect any rights a consumer may have which are unable to be excluded under Australian law.  To the fullest extent permitted by law, any liability of the Promoter or its employees or agents for breach of any such rights is limited to the payment of the costs of having the prize supplied again.
  19. A person who enters the Promotion releases from and indemnifies the Promoter from and against all liability, cost, loss or expense arising out of acceptance of any prize or participation in the Promotion including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission, or otherwise. A winner may be required to sign and return any liability release and provided by the Promoter as a condition of a prize being awarded. Failure to return the signed releases and indemnities will result in the entitlement to the prize being forfeited and a selection of another winner.
  20. In the event that a prize (or any part of a prize) becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a prize (or a part of a prize) with a prize of equal or greater value, subject to any written directions from any regulatory authority.
  21. To the extent that the Promoter has provided a value of a prize the Promoter accepts no responsibility for any change in prize value between the date of publication of such value and the ultimate prize redemption date. A prize must be taken as offered and cannot be varied. A prize or any unused portion of a prize is non-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash.
  22. To the extent that this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law  to disqualify any Local; or  subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
  23. Locals may be required to submit personal information to the Promoter in order to enter the Promotion. If the Local is not willing for this to occur the Local cannot participate in the Promotion.
  24. By entering the Promotion, unless otherwise advised, each Local agrees that the Promoter may use personal information collected to conduct the Promotion, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the Local.  The Promoter will hold personal information collected in a secure manner in accordance with the Promoter’s Privacy Policy for an indefinite period.  A request to access, update or correct any information should be directed to the Promoter.
  25. The Promoter reserves the right to alter these Terms and Conditions of entry without notice.
  26. All entries will be reviewed by the Promoter for compliance with these Terms and Conditions

COMPETITIONS: Terms and Conditions

Liquor Barons Co-Op Ltd (the “Promoter”) 2018 “Any and All Facebook Competitions” (the “Promotion”)

TERMS AND CONDITIONS

  1. Information on how to enter the Promotion and associated prizes form part of these Terms and Conditions.
  2. Entry into the Promotion is deemed acceptance of these Terms and Conditions by each entrant.
  3. The Promotion commences and concludes at the times specified in the Facebook competition post.
  4. Subject to these Terms and Conditions, entry to the Promotion is ONLY open to WA residents over the age of 18.
  5. Employees of the Promoter & Members of Liquor Barons Co-operative or employees of a Member Store, their retail stores and advisers (including any advertiser or advertising agency) and each of their immediate families are ineligible to enter the Promotion. Any party using ‘paid likes’ will be ineligible to enter the Promotion.
  6. To be eligible to enter the Promotion, an entrant must follow all the conditions listed in the initial Facebook post and following Facebook posts.
  7. When an eligible customer completes the conditions, they automatically receive one entry to go into the draw for a chance to win the prize specified in the Facebook post. The prize is non-refundable for Cash.
  8. Eligible customers (over 18YO, in WA). There is one prize to give away only.
  9. The Promoter encourages and promotes the responsible consumption of alcohol and reserves the right to disqualify and remove from our social channels any entrant/entry from the competition if the submitted content is deemed to be promoting the irresponsible consumption of alcohol.
  10. The winner will be chosen at random, provided all entry requirements have been met. The Promoter’s decision is final and no correspondence will be entered into.
  11. The Promoter will attempt to contact winner(s) using the Facebook profile provided by the entrant at the time of entering online. If for any reason the entrant’s details are completed incorrectly, the Promoter will not be held responsible. If for any reason the Promoter is unable to contact a winner within 2 days (which may be extended at the sole discretion of the Promoter) of the end of the Promotion, the winner will forfeit the prize and a re-draw will be conducted.
  12. A winner will be required to collect the Prize from the Promoter and provide proof of age.
  13. A Prize winner shall agree to participate in publicity or advertising as reasonably requested by the Promoter. Any user-generated content created for entry to any competition may be used by Liquor Barons at any time.
  14. Entrants may only enter in their own name. The Promoter reserves the right to request a winner to produce (within a requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the winners’ identity, age, residential address, eligibility to enter and claim the Prize, and any information submitted by the winner(s) in entering the Promotion before issuing a Prize. If the documentation required by the Promoter is not received by the Promoter or the winning entry has not been verified or validated to the Promoter’s satisfaction within the time requested, the winner’s entry will become invalid. In the event that a winner cannot provide suitable proof, the winner will forfeit a Prize in whole and no substitute will be offered. A Prize may only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
  15. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this Promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.
  16. The Promoter and its associated agencies, companies and members shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person’s negligence) in connection with using a Prize, except any liability that cannot be excluded by law (in which case the relevant liability is limited to the minimum allowable by law).
  17. A person who enters the Promotion releases from and indemnifies the Promoter from and against all liability, cost, loss or expense arising out of acceptance of any Prize or participation in the Promotion including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission, or otherwise. A winner may be required to sign and return any liability release and provided by the Promoter as a condition of a Prize being awarded. Failure to return the signed releases and indemnities will result in the entitlement to the Prize being forfeited and a selection of another winner.

To the extent that the Promoter has provided a value of a Prize the Promoter accepts no responsibility for any change in prize value between the date of publication of such value and the ultimate prize redemption date.   20.   21. Entrants may be required to submit personal information to the Promoter. The Promoter is bound by the National Privacy Principles set out in the Privacy Act 1988 (Cth) and will manage the entrants’ personal information in accordance with the Promoter’s privacy policy as published at [insert link to privacy policy] (the “Privacy Policy”). A request to access, update or correct any information should be directed to the Promoter at the address set out in the privacy policy. Entrants to the Promotion consent to the storage of their personal information on the databases of the Promoter (and its related bodies corporate), and agree that the Promoter (and its related bodies corporate) may (i) use any personal information supplied in connection with the Promotion for its own marketing, planning, product development, advertising data support, promotional and research purposes (ii) disclose entrants’ personal information to its contractors and agents to assist in conducting the Promotion or communicating with entrants (iii) refuse to accept an entry to the Promotion which does not contain all or any of the personal information requested by the Promoter and (iv) disclose personal information to regulatory bodies, and publish winners’ names as required under any relevant legislation.

Terms & Conditions of Liquor Barons’ Instagram Competitions

Liquor Barons Co-Op Ltd (the “Promoter”) 2018 “Any and All Instagram Competitions” (the “Promotion”)

  1. Information on how to enter the Promotion and associated prizes form part of these Terms and Conditions.
  2. Entry into the Promotion is deemed acceptance of these Terms and Conditions by each entrant.
  3. The Promotion commences and concludes at the times specified in the Instagram competition post.
  4. Subject to these Terms and Conditions, entry to the Promotion is ONLY open to WA residents over the age of 18.
  5. Employees of the Promoter & Members of Liquor Barons Co-operative or employees of a Member Store, their retail stores and advisers (including any advertiser or advertising agency) and each of their immediate families are ineligible to enter the Promotion. Any party using ‘paid likes’, ‘paid follows’, or ‘paid comments’ will be ineligible to enter the Promotion.
  6. To be eligible to enter the Promotion, an entrant must follow all the conditions listed in the initial Instagram post and following Instagram posts.
  7. When an eligible customer completes the conditions, they automatically receive one entry to go into the draw for a chance to win the prize specified in the Instagram post. The prize is non-refundable for Cash.
  8. Eligible customers (over 18YO, in WA). There is one prize to give away only.
  9. The Promoter encourages and promotes the responsible consumption of alcohol and reserves the right to disqualify and remove from our social channels any entrant/entry from the competition if the submitted content is deemed to be promoting the irresponsible consumption of alcohol.
  10. The winner will be chosen at random, provided all entry requirements have been met. The Promoter’s decision is final and no correspondence will be entered into.
  11. The Promoter will attempt to contact winner(s) using the Instagram profile provided by the entrant at the time of entering online. If for any reason the entrant’s details are completed incorrectly, the Promoter will not be held responsible. If for any reason the Promoter is unable to contact a winner within 2 days (which may be extended at the sole discretion of the Promoter) of the end of the Promotion, the winner will forfeit the prize and a re-draw will be conducted.
  12. A winner will be required to collect the Prize from the Promoter and provide proof of age.
  13. A Prize winner shall agree to participate in publicity or advertising as reasonably requested by the Promoter.
  14. Entrants may only enter in their own name. The Promoter reserves the right to request a winner to produce (within a requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the winners’ identity, age, residential address, eligibility to enter and claim the Prize, and any information submitted by the winner(s) in entering the Promotion before issuing a Prize. If the documentation required by the Promoter is not received by the Promoter or the winning entry has not been verified or validated to the Promoter’s satisfaction within the time requested, the winner’s entry will become invalid. In the event that a winner cannot provide suitable proof, the winner will forfeit a Prize in whole and no substitute will be offered. A Prize may only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
  15. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this Promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.
  16. The Promoter and its associated agencies, companies and members shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person’s negligence) in connection with using a Prize, except any liability that cannot be excluded by law (in which case the relevant liability is limited to the minimum allowable by law).
  17. A person who enters the Promotion releases from and indemnifies the Promoter from and against all liability, cost, loss or expense arising out of acceptance of any Prize or participation in the Promotion including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission, or otherwise. A winner may be required to sign and return any liability release and provided by the Promoter as a condition of a Prize being awarded. Failure to return the signed releases and indemnities will result in the entitlement to the Prize being forfeited and a selection of another winner.
  18. In the event that a Prize (or any part of a Prize) becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a Prize (or a part of a Prize) with a prize of equal or greater value, subject to any written directions from any regulatory authority.
  19. To the extent that the Promoter has provided a value of a Prize the Promoter accepts no responsibility for any change in prize value between the date of publication of such value and the ultimate prize redemption date. A Prize must be taken as offered and cannot be varied. A prize or any unused portion of a Prize is non-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash.
  20. To the extent that this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
  21. Entrants may be required to submit personal information to the Promoter. The Promoter is bound by the National Privacy Principles set out in the Privacy Act 1988 (Cth) and will manage the entrants’ personal information in accordance with the Promoter’s privacy policy as published at [insert link to privacy policy] (the “Privacy Policy”). A request to access, update or correct any information should be directed to the Promoter at the address set out in the privacy policy.
